LIMITED WARRANTY FOR WORKMANSHIP AND DEFECTS (ONE YEAR)
1. Limited Warranty Coverage
August & Ivy™ Co. (“Company”) warrants that the accompanying diaper bag (“Product”) will be free from defects in materials and workmanship under normal use for a period of one (1) year from the date of original retail purchase (“Warranty Period”).
2. What This Warranty Covers
During the Warranty Period, this warranty covers:
Defects in materials, including fabric, stitching, hardware, and structural components.
Defects in workmanship arising from the manufacturing process.
If a covered defect arises and a valid claim is received within the Warranty Period, the Company will, at its option:
Repair the Product,
Replace the Product with the same model or a comparable model, or
Refund the original purchase price upon return of the Product.
3. What This Warranty Does Not Cover
This limited warranty does not cover:
Normal wear and tear, including fading, scuffing, or cosmetic changes.
Damage caused by misuse, abuse, neglect, accidents, or improper care.
Damage resulting from modifications, alterations, or unauthorized repairs.
Loss, theft, or damage to items stored inside the Product.
Products purchased from unauthorized sellers or resellers.
4. Warranty Claim Process
To submit a warranty claim, the purchaser must provide:
Proof of purchase showing the date and place of purchase,
A description of the defect, and
Photographs or other evidence reasonably requested by the Company.
The Company may require the Product to be returned for inspection before determining eligibility.
5. Limitations and Disclaimers
To the maximum extent permitted by applicable law:
This limited warranty is the exclusive warranty for the Product.
The Company disclaims all other warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose.
The Company is not liable for any incidental, consequential, or special damages arising out of or related to the use of the Product.
Some jurisdictions do not allow limitations on implied warranties or the exclusion of incidental or consequential damages, so these limitations may not apply to you.
6. Transferability
This warranty applies only to the original purchaser and is not transferable.
7. Governing Law
This limited warranty is governed by the laws of the state in which the original purchaser resides, unless otherwise required by applicable consumer protection laws.
DISCLAIMER OF OTHER WARRANTIES
EXCEPT FOR THE LIMIT WARRANTY EXPRESSLY SET FORTH ABOVE, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE NON-INFRINGEMENT, AS WELL AS ANY WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE . NO ORAL OR WRITTEN INFORMATION OR ADVICE PROVIDED BY THE COMPANY OR IS AUTHORIZED REPRESENTATIVES SHALL CREATE AND WARRANTY NOT EXPRESSLY SSTATE IF IN THIS LIMITED WARRANTY.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law,
THE COMPANY’S SOLE AND EXCLUSIVE LIABILITY FOR ANY DEFECT IN THE PRODUCT, AND THE PURCHASER’S SOLE AND EXCLUSIVE REMEDY, IS LIMITED TO THE REPAIR OR REPLACEMENT OF THE PRODUCT AS
DESCRIBED IN THIS LIMITED WARRANTY.
UNDER NO CIRCUMSTANCES SHALL THE COMPANY BE LIABLE FOR ANY OTHER DAMAGES OR REMEDIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:
INCIDENTAL, CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES
LOSS OF USE, LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF PERSONAL PROPERTY
ANY COSTS ASSOCIATED WITH OBTAINING SUBSTITUTE GOODS OR SERVICES
THE COMPANY’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE PRODUCT SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE OF THE PRODUCT.
Repair or replacement may involve the use of new, refurbished, or functionally equivalent parts or products. Any repaired or replacement product is warranted only for the remainder of the original Warranty Period.
NOTICE REGARDING STATE LAW VARIATIONS
Some states do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages. As a result, one or more of the above disclaimers, exclusions, or limitations may not apply to you, and you may have additional rights that vary from state to state. This limited warranty gives you specific legal rights, and you may also have other rights depending on your state of residence.
